Regulation 19 and Schedule 3 are unambiguous: before a person starts work in a care home, the provider must hold proof of identity, an enhanced DBS check with the appropriate barred list, satisfactory conduct in previous employment, a full employment history with explained gaps, evidence of qualifications, and evidence of physical and mental fitness for the role. This module is that requirement turned into a working pipeline — an advert that attracts the right person, a question bank that tests values rather than memory, a tracker that will not let a start date pass with a check outstanding, and an induction that gets a new starter safely to the floor.
The second half of the module is what happens after someone joins. Induction checklists at Day 1, Week 1 and Month 1. Probation reviews at one, three and six months. And a full disciplinary and grievance suite written to the ACAS Code of Practice, including the safeguarding overlay for the case every care home dreads: an allegation against a member of staff, where the employment process and the safeguarding process have to run side by side without contaminating each other.
What this module is written against
Written for England. Every citation below is a CQC regulation, an English statutory instrument, or national guidance an English care home is measured against — no generic UK-wide hedging.
- CQC Regulation 19 and Schedule 3
- Fit and proper persons employed — the check set that must be complete before a start date, held on file and auditable.
- CQC Regulation 18
- Staffing — sufficient numbers of suitably qualified, competent, skilled and experienced staff, with induction, training and supervision evidenced.
- CQC Regulation 13
- Safeguarding — the disciplinary route where an allegation involves a resident, and the DBS referral duty that can follow.
- Safeguarding Vulnerable Groups Act 2006
- Barred list checks, regulated activity definitions, and the duty to refer to DBS.
- ACAS Code of Practice
- Disciplinary and grievance procedure — following it is what makes a dismissal defensible at tribunal.
- Equality Act 2010
- Recruitment free of discrimination, reasonable adjustments at interview and in post, and lawful health questions.
