Core Compliance

Core Compliance is the policy set a CQC-registered care home in England is expected to hold, in force and evidenced, from the day it opens. It covers the fundamental standards in the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 — Regulations 9 through 20A — and the England legislation sitting underneath them: the Mental Capacity Act 2005, the Care Act 2014, the Health and Safety at Work etc. Act 1974 and its subordinate regulations, the Regulatory Reform (Fire Safety) Order 2005, UK GDPR and the Data Protection Act 2018, and the Equality Act 2010.

Each document does one job. The policy states the position the organisation takes and the standard staff are held to. The procedure tells a member of staff what to do, in order, at the point it matters. The form captures the evidence an inspector will later ask to see. The wall poster puts the critical few steps where they are needed — by the sluice, in the medication room, at the fire panel. Every one of them is personalised on download with your registered manager, your safeguarding lead, your DPO, your address and your CQC registration ID, so nothing arrives with somebody else’s name in it.

What this module is written against

Written for England. Every citation below is a CQC regulation, an English statutory instrument, or national guidance an English care home is measured against — no generic UK-wide hedging.

CQC Regulations 9, 9A, 10, 11
Person-centred care, visiting and accompanying, dignity and respect, and consent — the resident-facing standards.
CQC Regulations 12, 13, 14, 15
Safe care and treatment, safeguarding from abuse, nutrition and hydration, premises and equipment — the safety spine.
CQC Regulations 16, 17, 18, 19, 20, 20A
Complaints, good governance, staffing, fit and proper persons employed, duty of candour, and display of ratings.
CQC (Registration) Regulations 2009
Statement of purpose (Reg 12) and the statutory notifications to CQC (Regs 14–18).
Mental Capacity Act 2005 and DoLS
Capacity assessment, best-interests decision-making, and deprivation-of-liberty authorisation.
Health and safety law
HSWA 1974, COSHH 2002, RIDDOR 2013, the Manual Handling Operations Regulations 1992, LOLER 1998, and the Regulatory Reform (Fire Safety) Order 2005.
UK GDPR and Data Protection Act 2018
Lawful processing of health data, subject rights, breach reporting, and the Records Management Code of Practice 2021.
